Customer terms
Last updated: 18 October 2026
These terms are the contract between Our Man in the Fifth Ltd and the business that holds a Marker account. Please read them. They are written to be plain, and the parts that limit what we owe you are in section 13.
1. Who we are and who these terms are for
1.1 Marker is provided by Our Man in the Fifth Ltd, a company registered in England and Wales, company number 15759779, registered office 794 High Street, Kingswinford, West Midlands, DY6 8BQ ("we", "us"). You can reach us at hello@markerapp.co.uk.
1.2 "You" means the person or business that holds a Marker account. Marker is for businesses. By starting a free trial, subscribing or accepting an invitation, you confirm that you are 18 or over, that you are using Marker for your business, and that you can agree to these terms for that business.
1.3 You agree to these terms when you start a free trial, subscribe or accept an invitation. Our data processing agreement forms part of these terms and covers your clients' personal data. Our privacy policy explains how we use your own data.
2. What Marker does
2.1 Marker takes the transcript of a training session and your notes, and drafts a client report in your branding, with your own videos, courses and services in it. You can edit the report and download it as a PDF.
2.2 Reports are drafted by AI. Anthropic's Claude writes them, and OpenAI types out voice notes. AI can get things wrong: it can mishear, leave things out or state something that was not said.
2.3 You must read and check every report before you send it. What you send to your clients is your advice and your responsibility. Marker does not give veterinary, behavioural or any other professional advice of its own.
2.4 You need a transcript of the session to use Marker. Marker does not record your sessions or take session recordings. How to get a transcript is explained on our home page.
3. Free trial
3.1 You can try Marker for 5 reports free, without a card. We email you a link to start, which works once and lasts 48 hours.
3.2 You can subscribe from Settings at any time. Your account, settings and reports carry over.
3.3 If you do not subscribe, we delete your trial account and everything in it 60 days after you sign up. We email you a week before.
3.4 One free trial per business. We may refuse or end a trial that is being used to get round this.
4. Plans and price
4.1 Marker is a monthly subscription. There is no setup fee.
- Starter, £15 a month: up to 15 reports a month.
- Pro, £25 a month: 16 to 50 reports a month.
4.2 Everyone starts on Starter. If you write more than 15 reports a month for two calendar months running, you move to Pro from your next bill. If you then write 15 or fewer for two months running, you move back to Starter from your next bill. We email you whenever your plan changes.
4.3 Fair use. Either plan covers up to 50 reports a month. If you reach 50, drafting stops until the 1st of the next month. Get in touch if you need more.
4.4 We are not registered for VAT, so no VAT is added. If that changes, we will give you at least 30 days' notice of how it affects your price.
4.5 Referral codes. If you join with a referral code from one of our introducers, your first 15 reports are free. You add a card when you sign up, and your first payment is taken when you have used them, or 60 days after you sign up if that comes first, unless you cancel before then. A referral code is for new accounts only. It cannot be added to an account that already exists, or used on top of the free reports, and each business gets one free period. We may pay the introducer a share of your first payments. This does not change your price.
5. Paying
5.1 You pay monthly in advance by card through Stripe. We never see your card number.
5.2 If a payment fails, we email you. You can keep drafting reports for 7 days while you update your card under Manage billing in Settings. After that, drafting pauses until payment is made. Your reports stay safe. If payment is still not made, Stripe may end your subscription, and section 7 then applies.
5.3 We may change our prices. We will email you at least 30 days before a change affects you, so you can cancel first if you want to.
6. Cancelling
6.1 You can cancel at any time from Settings, under Manage billing. Your subscription runs to the end of the month you have paid for. We do not refund part months.
6.2 This does not affect any right you have under law that cannot be excluded.
7. When your subscription ends
7.1 We email you when your subscription ends. For 30 days after that you can still sign in, open your reports and download them as PDFs, but not draft new ones.
7.2 After those 30 days, your account and everything in it is deleted automatically and cannot be recovered. Download anything you want to keep before then.
8. Ending your account
8.1 We may suspend or end your account if you seriously or repeatedly break these terms, or if you do not pay. Where it is reasonable, we will warn you first and give you a chance to put things right.
8.2 If we decide to stop providing Marker altogether, we will give you at least 30 days' notice and time to download your reports, and we will not charge you for any period after it stops.
9. Your content
9.1 Your reports, transcripts, notes, logo and other material you put into Marker belong to you, or to whoever owns them now. You give us permission to store and process them only to run Marker for you.
9.2 We do not use your content or your clients' data to train AI models, and our AI suppliers do not either.
9.3 You confirm that you have the right to use the logo, names, videos and other material you add, and that using them in Marker will not break anyone else's rights.
10. Your clients' data
10.1 You are responsible for having a lawful basis to record your sessions and to put your clients' details into Marker, and for telling your clients how you use them, including that an AI service drafts your reports. Settings has ready-made wording you can use.
10.2 We process your clients' data for you, as your processor, under our data processing agreement.
11. Using Marker properly
You must not:
- use Marker for anything unlawful, or to make anything misleading, defamatory or harmful;
- share your account or password with anyone outside your business;
- try to get into anyone else's account or data, or to get round the plan limits, fair use or free trial;
- copy, take apart or resell Marker, or build a competing product from it;
- overload Marker, upload anything harmful, or use automated tools to draft reports in bulk;
- use Marker in a way that breaks Anthropic's or OpenAI's usage policies.
If you connect a YouTube channel, you agree to the YouTube Terms of Service.
12. Our software and the service
12.1 We own Marker, its software, design and name. While your subscription runs, you have a non-exclusive right to use Marker for your business. It cannot be transferred.
12.2 We aim to keep Marker running and working well, but we cannot promise it will never be interrupted or free of faults. We may need to take it offline for maintenance, and we depend on suppliers such as Netlify, Anthropic and OpenAI.
12.3 We improve Marker over time and may change how it works. If we make a change that takes away something important you pay for, we will tell you first, and you can cancel.
13. What we are responsible for
13.1 Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit.
13.2 We are not responsible for:
- the content of reports you send, or decisions made on them, since you check every report before it goes out;
- loss of profits, sales, business, goodwill or data, or any indirect or consequential loss;
- problems caused by your own equipment, internet connection or transcripts, or by events outside our reasonable control.
13.3 Our total liability to you in any 12 months is limited to the greater of £100 and the amount you paid us for Marker in those 12 months.
14. Other services
Our brand and website packages and coaching sessions are separate from the Marker subscription. Their price and terms are set out when you book them.
15. Changes to these terms
We may update these terms. We will post the new version here and change the date at the top. If a change is significant, we will email you at least 30 days before it applies. If you keep using Marker after that, the new terms apply. If you do not agree, you can cancel.
16. General
16.1 These terms, the data processing agreement and the privacy policy are the whole agreement between us about Marker.
16.2 If a court finds part of these terms cannot be enforced, the rest still applies.
16.3 We may transfer this agreement to anyone who takes over Marker. We will tell you if we do. You may not transfer it without our agreement.
16.4 Nobody else has any right to enforce these terms.
16.5 If we do not enforce a right straight away, we can still enforce it later.
16.6 These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
